Apple appeal
Well, Apple, one out of four aint bad, and judge Everingham did grant the company's motion for judgment as a matter of law, saying he believed it to be true that the fruity firm didn't ‘willfully' infringe OPTi's patent.
He still maintained, however, that Apple was indeed guilty of infringing it - even if by accident - and so the penalty of $19 million, plus another $2.7 million in interest remained.
Fair's fair, though and the judge ruled that OPTi's motion for enhanced damages wasn't justified.
Despite this, however, Apple seems unwilling to let the matter go, immediately petitioning the US Court of appeals to overturn the verdict.
Let's just hope for its sake this doesn't go pear shaped.
